Terms of Service for makevoice.io

1. General Provisions

1.1. These terms of service (hereinafter referred to as “Terms”) define the rules for using the makevoice.io website (hereinafter referred to as “Service”).

1.2. The owner of the Service and the entity providing services is OPTIMUM, located at ul. Pozytywistów 4/4, 20-639 Lublin, NIP: 7120311746, REGON: 430325730 (hereinafter referred to as “Service Provider”).

1.3. Using the Service means acceptance of these Terms by the User.

2. Definitions

2.1. User – any natural or legal person using the Service.

2.2. Services – all services provided electronically by the Service Provider via the Service.

2.3. Account – the individual administrative panel of the User, accessible after registration and login to the Service.

3. Conditions of Use of the Service

3.1. Registration in the Service is voluntary and free of charge.

3.2. The User is obliged to provide true data during registration.

3.3. The User agrees to use the Service in accordance with the law and the provisions of these Terms.

4. Services Provided by the Service

4.1. The Service offers tools for generating speech from text (Text-to-Speech).

4.2. Services may be provided both free of charge and paid, in accordance with the current offer available on the Service’s website.

4.3. The Service Provider reserves the right to change the service offer, including introducing new features and modifying existing ones.

5. Payments

5.1. All payments for paid services are made in accordance with the price list available on the Service’s website.

5.2. The User may make payments using available payment methods: credit card, bank transfer, PayPal, etc.

6. Liability

6.1. The Service Provider is not liable for damages resulting from the use of the Service in a manner inconsistent with the Terms or the law.

6.2. The Service Provider reserves the right to temporarily suspend the operation of the Service for maintenance or update purposes.

7. Complaints

7.1. The User has the right to file complaints regarding the functioning of the Service.

7.2. Complaints should be submitted electronically to the address: support@makevoice.io.

7.3. The Service Provider will consider the complaint within 14 days of its receipt and inform the User of the outcome of the complaint procedure.

8. Provisions Regarding Entrepreneurs

8.1. This section of the Terms and the provisions contained therein apply only to Clients and Service Users who are not consumers.

8.2. The Service Provider has the right to withdraw from the Agreement concluded with a Client who is not a consumer within 14 calendar days from the date of its conclusion. Withdrawal from the Agreement in this case may occur without giving a reason and does not give rise to any claims on the part of the Client who is not a consumer against the Service Provider.

8.3. In the case of Clients who are not consumers, the Service Provider has the right to limit the available payment methods, including requiring prepayment in whole or in part, regardless of the payment method chosen by the Client and the fact of concluding a Sales Agreement.

8.4. Pursuant to Article 558 § 1 of the Civil Code, the Service Provider’s liability under the warranty for Digital Content towards a Client who is not a consumer is excluded.

8.5. In the case of Service Users who are not consumers, the Service Provider may terminate the agreement for the provision of the Electronic Service with immediate effect and without giving reasons by sending the Service User an appropriate statement.

8.6. The Service Provider’s/Seller’s liability towards the Service User/Client who is not a consumer, regardless of its legal basis, is limited – both within a single claim and for all claims in total – to the amount of the price paid and the delivery costs under the Sales Agreement, but not more than to the amount of one thousand PLN. The Service Provider/Seller is liable to the Service User/Client who is not a consumer only for typical foreseeable damages at the time of concluding the agreement and is not liable for lost profits in relation to the Service User/Client who is not a consumer.

8.7. Any disputes arising between the Seller/Service Provider and the Client/Service User who is not a consumer will be submitted to the court having jurisdiction over the Service Provider’s registered office.

9. Personal Data Protection

9.1. The Service Provider processes the personal data of Users in accordance with the Privacy Policy available on the Service’s website.

9.2. The User has the right to access their personal data, modify it, and delete it.

10. Final Provisions

10.1. The Service Provider reserves the right to change these Terms. Users will be informed of any changes electronically.

10.2. Matters not regulated by these Terms are governed by Polish law.
